 Zephyr  Skipper & Crew Liability

 

                                                      

Dear fellow Sailor:

 

It has been the practice of SEAS Skippers to give every crewmember the opportunity to actively participate in sailing the boats. With this practice also came the responsibility to participate and equally share in the liability in the unlikely event of damage. 

Zephyr  is insured for damage with a deductible of $500, damage liability to others with a deductible of $1,000.

 If you would rather not share liability in case of damage, you may indicate that you prefer to be strictly a passive passenger by printing the attached document, signing, dating and attaching the original to the appropriate page in the log book.  Absent this document, all crew, skippers and passengers agree to share liability and the costs associated.

During a chapter-sponsored educational activity, the sponsoring chapter is responsible for this amount.

It is also assumed that all members, skippers, crew and passengers aboard any SEAS vessels are voluntarily participating in sailing activities and/or courses, and that they further realize and accept that this sport has some inherent potential dangers and do hereby release and hold harmless the Society for the Education of American Sailors, Inc., its parent, sister corporations, and subsidiaries, and each of its members, instructors, aides or any individual, corporation, or government agency whose facilities or equipment are used in the conduct of SEAS activities, from liability to me, my heirs, and assigns, for any injury or damage caused by any action or omission including negligence on the part of the aforementioned.

Incidents

All incidents involving bodily injury or property damage should be verbally reported to the SEAS Bergen

Keelboat Committee Chair as soon as is practicably possible.  Additionally, an Incident Report Form

should be completed by the skipper and forwarded to the Keelboat Committee Chair within 24 hours. 

Steps should be taken to prevent the next persons scheduled to use the boat from encountering any safety

hazard due to damaged equipment.
